Description of Services
:PitchNXT - Your Next Gen Campaign Platform provides a WhatsApp Business API platform that enables businesses to:
- Send and receive WhatsApp messages at scale
- Create and manage message templates
- Build automated chatbots and workflows
- Manage customer contacts and groups
- Integrate with third-party applications
- Access analytics and reporting features
Account Registration
To use our services, you must:
- Be at least 18 years old or have legal authority to enter into agreements
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
Acceptable Use
You agree NOT to use our platform to:
- Send spam, unsolicited messages, or bulk marketing without consent
- Violate WhatsApp's Business Policy or Commerce Policy
- Transmit illegal, harmful, or offensive content
- Impersonate others or misrepresent your identity
- Attempt to hack, disrupt, or overload our systems
- Collect personal data without proper consent
- Violate any applicable laws or regulations
Warning: Violation of these terms may result in immediate account suspension or termination.
Payment Terms
- Subscription Fees: Fees are billed in advance on a monthly or annual basis.
- WhatsApp API Costs: Conversation charges from Meta/WhatsApp are passed through with 0% markup.
- Refunds: Subscription fees are non-refundable. Contact support for special circumstances.
- Payment Methods: We accept major credit cards and other payment methods as displayed.
- Failed Payments: We may suspend services for failed or declined payments.
WhatsApp Business API Terms
By using our platform, you also agree to:
- Meta's WhatsApp Business Terms of Service
- WhatsApp Business Policy and Commerce Policy
- Meta's Data Processing Terms
Note: We act as an authorized Business Solution Provider (BSP) for WhatsApp Business API.
Intellectual Property
All content, features, and functionality of our platform are owned by :PitchNXT - Your Next Gen Campaign Platform and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
Limitation of Liability
To the maximum extent permitted by law, :PitchNXT - Your Next Gen Campaign Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
Either party may terminate this agreement:
- You may cancel your subscription at any time through your account settings
- We may suspend or terminate your account for violations of these terms
- Upon termination, your access to the platform will be revoked
- You may request export of your data within 30 days of termination
Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes via email or platform notification. Continued use of our services after changes constitutes acceptance of the new terms.
